JSC “State Joint Stock Company “Automobile Roads of Ukraine” reports that as a result of comprehensive measures of the Security Service, the National Police and the Prosecutor General’s Office, the heads of the subsidiary “Kyiv Regional Road Administration” (SE “Kyiv Regional Road Administration”) were detained.
- The arbitration manager – the rehabilitation manager of SE “Kyiv Regional Road Administration” was detained, who was performing his duties in accordance with the Resolution of the Economic Court of Kyiv dated 02/25/2013 in case No. 44/258-b, taking into account the fact that SE “Kyiv Regional Road Administration” had been in rehabilitation since 2013.
Therefore, from the moment of the Resolution on the introduction of the rehabilitation procedure, the management of the debtor passed to the rehabilitation manager.
- According to the rehabilitation plan, the executive director is appointed by the arbitration manager and he also influences all other personnel appointments.
Accordingly, the State Enterprise “Kyiv Regional Road Administration” was legally outside the Company’s management area.
This is a warning to other arbitration managers regarding their responsibility for managing property owned by the State.
